Filing a Discrimination Complaint
Notice - Discrimination on the following bases is prohibited in Agency programs:
- Race
- Color
- Disability
- Religion
- Sex
- National origin
- Age
- Marital status
- Political affiliation or belief
- Participation in any WIA Title I financially assisted program or activity
- Citizenship or status as a lawfully admitted immigrant authorized to work in the U.S.

Who may file with the Agency for Workforce Innovation's Office for Civil Rights?
Any person who feels he or she has been subjected to unlawful discrimination by:
- a policy, program, activity or employee of our agency;
- a recipient (contractor or service provider) that receives federal financial assistance through our agency.
For example, this may include:
- Customers in the One-Stop Centers, such as:
Job seekers
Applicants for unemployment benefits
Applicants for job-training programs - Participants in job-training programs
- Applicants for employment with our agency
- Agency employees

Time Limit for Filing:
A charge of employment discrimination, filed with the Office for Civil Rights under federal law, must be filed within 180 calendar days of the alleged act of discrimination. A charge of employment discrimination, filed with the Office for Civil Rights under Florida law, must be filed within 365 calendar days of the alleged act of discrimination. A charge of discrimination in services, filed with the Office for Civil Rights, must be filed within 180 calendar days of the alleged act of discrimination. “Filing” means a written complaint must be received by the Office for Civil Rights before the expiration of the 180- or 365-day period for filing, as applicable. Complaints received after the filing deadline will be returned to the complainant with a notice of options for filing with either a federal or state enforcement agency, unless the time in which to file with the Office for Civil Rights has been extended under applicable federal regulation.
